Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and BTWNBROS ("BTWNBROS," "we," "us," or "our"), governing your access to and use of the BTWNBROS platform, application, website, and all related services (collectively, the "Platform"). By accessing, browsing, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

By accessing or using the Platform, you further confirm that you are at least eighteen (18) years of age, that you possess the legal right to access adult content in your jurisdiction, and that you consent to be bound by these Terms, our Privacy Policy, and all other policies referenced herein.

BTWNBROS maintains a strict zero-tolerance policy regarding minors. If you are under eighteen (18) years of age, you are expressly prohibited from accessing or using this Platform. We employ multiple layers of age verification including government-issued identification verification, date of birth cross-referencing, human review, and permanent identity binding.

Age Verification

BTWNBROS requires government-issued photo identification for all account applicants. Age verification shall occur prior to human review and prior to any profile approval.

• A valid government-issued photo ID (passport, driver's license, or national ID) must be submitted during account creation.
• The date of birth on the submitted ID must confirm the applicant is eighteen (18) years of age or older.
• Each account shall be permanently linked to the Member's verified identity. One government ID, one Member, one account. All accounts require government-issued photo ID verification; accordingly, each individual may only maintain one BTWNBROS account. Any attempt to create a second account shall result in immediate termination and a permanent ban.
• Account creation requires payment of a non-refundable verification fee to fund the human review process. The current fee amount is disclosed during account registration.

BTWNBROS shall cooperate fully with law enforcement and shall immediately terminate and report any account found to belong to a minor, as required under 18 U.S.C. 2258A and applicable law.

Prohibited Content & Conduct

The following are strictly prohibited on the Platform and shall result in immediate, permanent account termination without refund, potential device ban, and mandatory reporting to the appropriate authorities:

• Child Sexual Abuse Material (CSAM): Any content depicting minors in a sexual or exploitative manner, whether photographic, illustrated, animated, or AI-generated. Zero exceptions. Zero appeals.
• Non-consensual imagery: Distributing intimate images of any person without their explicit consent.
• Harassment and threats: Targeted abuse, threats of violence, stalking, or any form of intimidation directed at another Member or third party.
• Commercial solicitation: Offering or soliciting payment for sexual services on the Platform.
• Impersonation: Creating accounts representing real individuals without their consent.
• Unauthorized data collection: Scraping, harvesting, or otherwise extracting Member data from the Platform by any means.

Content Moderation

BTWNBROS employs automated image scanning technology that shall review every photo and video uploaded to the Platform prior to delivery to any other Member. This process cannot be bypassed or disabled by any Member action.

HO-FACTS Rating System

Within fourteen (14) days of any meetup between Members, both parties shall be required to submit a HO-FACTS report. This report is permanent, immutable, and accessible to all Platform Members. HO-FACTS reports evaluate: Cleanliness, Vibe/Chemistry, Intensity, Communication, Punctuality, Overall, and Would Meet Again.

Each account shall be entitled to one (1) appeal of a HO-FACTS rating. The appeal process is described in the Appeals section of these Terms. The outcome of any such appeal shall be final and binding.

Membership Dues & Billing

BTWNBROS offers membership tiers including free and premium options. Dues details, feature availability, and current pricing are available within the club at the time of enrollment. BTWNBROS reserves the right to modify membership tiers, features, and dues at any time upon reasonable notice to Members.

Discreet Billing

Members may select a custom merchant name to appear on their billing statement. Available options shall be provided during membership enrollment. "BTWNBROS" shall not appear on billing statements unless explicitly selected by the Member.

All membership dues are non-refundable. Cancellation shall take effect at the end of the then-current billing period. Membership application and verification fees are non-refundable under all circumstances.

Termination

BTWNBROS reserves the right to suspend or terminate any account at any time, for any reason or no reason, including but not limited to: violation of these Terms, conduct detrimental to the Platform community, fraudulent activity, or any behavior deemed inconsistent with the safety and integrity of the Platform.

Termination for CSAM violations shall be immediate, permanent, and not eligible for appeal under any circumstances. BTWNBROS shall cooperate fully with law enforcement investigations arising from CSAM incidents.

Terminated accounts shall not be entitled to a refund of any fees paid, including subscription fees for the unused portion of any billing period.

Appeals Process

Members whose accounts have been terminated for reasons other than CSAM violations may submit one (1) appeal. The appeals process shall proceed as follows:

1. The Member shall submit an appeal via email to appeals@btwnbros.com within thirty (30) days of the termination notice.
2. BTWNBROS shall acknowledge receipt of the appeal within forty-eight (48) business hours.
3. Review shall be completed within fourteen (14) business days of acknowledgment.
4. The decision rendered shall be final and binding. No further appeals shall be permitted.

Limitation of Liability

To the fullest extent permitted by applicable law, BTWNBROS, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if BTWNBROS has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless BTWNBROS and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

BTWNBROS's total aggregate liability to you for any and all claims arising under or in connection with these Terms shall not exceed the total fees paid by you to BTWNBROS in the twelve (12) months immediately preceding the event giving rise to the claim.

Governing Law & Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or the breach, termination, or validity thereof, shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the State of Wyoming. The arbitrator's decision shall be final and may be entered as a judgment in any court of competent jurisdiction.

You hereby waive any right to participate in class action litigation or class-wide arbitration. All claims shall be brought in the Member's individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Privacy

Your use of the Platform is additionally governed by our Privacy Policy, which is incorporated into these Terms by reference. You are encouraged to review our Privacy Policy carefully prior to using the Platform.

In summary: BTWNBROS does not sell your data. BTWNBROS does not serve targeted advertising. BTWNBROS shall not share your information with third parties except as required for Platform operation, legal compliance, or safety emergencies as further described in our Privacy Policy.

Platform Confidentiality Commitment

BTWNBROS is committed to the privacy and discretion of every Member. BTWNBROS shall never confirm, deny, or disclose the membership status, identity, profile content, activity, or any other personally identifying information of any Member to any third party, including but not limited to spouses, domestic partners, family members, employers, government agencies, or the general public, except under the following limited circumstances:

• (a) Legal Process: In response to a valid and lawful court order, subpoena, warrant, or other legally binding legal process issued by a court or governmental authority of competent jurisdiction.
• (b) Mandatory Reporting: When required to report suspected child sexual abuse material to the National Center for Missing and Exploited Children ("NCMEC") pursuant to 18 U.S.C. 2258A or any successor statute.
• (c) Imminent Harm: When, in the sole and reasonable judgment of BTWNBROS, disclosure is necessary to prevent imminent physical harm to a Member or third party.
• (d) Member Consent: With the express, informed, written consent of the Member whose information is at issue, provided such consent is given voluntarily and not under duress.

BTWNBROS shall not respond to informal requests for Member information from spouses, domestic partners, private investigators, or any other third party acting outside of a formal legal process as described in clause (a) above.

Modifications and Amendments

BTWNBROS reserves the right, at its sole discretion, to modify, amend, or replace these Terms at any time. In the event of material changes, BTWNBROS shall provide notice to Members through the Platform or via the email address associated with the Member's account. Such notice shall be provided at least thirty (30) days prior to the effective date of the revised Terms, unless a shorter notice period is required by law or exigent circumstances.

Your continued use of the Platform following the effective date of any revised Terms shall constitute your acceptance of and agreement to such revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform and terminate your account prior to the effective date.

Severability

If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent. If such modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

Waiver

No failure or delay by BTWNBROS in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any further or other exercise of that or any other right, power, or remedy. A waiver of any provision of these Terms shall be effective only if made in writing and signed by an authorized representative of BTWNBROS.

Entire Agreement

These Terms, together with the Privacy Policy, Child Safety Policy, and any other policies or agreements expressly incorporated by reference herein, constitute the entire agreement between you and BTWNBROS with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, understandings, and agreements, whether oral or written, between you and BTWNBROS regarding the Platform.
